As predicted at the South Burnett Regional Council’s May meeting, a company denied permission to build a Battery Energy Storage System (BESS) beside the Kingaroy Solar Farm is challenging the decision in court.
The appellant is M Renewables Australia Developments, a subsidiary of Metlen Energy & Metals (formerly known as Mytilineos), the constructors and owners of the Kingaroy Solar Farm.
Solicitors for M Renewables lodged a Notice Of Appeal in the Planning and Environment Court on June 24.
King & Company Solicitors, for the SBRC, entered an appearance in the matter last week (July 8).
M Renewables is seeking orders that its application for a Development Permit for material change of use and reconfigure a lot for the BESS be approved.
The parcel of land is already subject to a Development Permit for a solar farm.
In May, councillors acknowledged the company could challenge their decision in court, but also expressed hope the State Government might “call in” the project before any appeal was lodged.
