Wagners have launched legal action against Toowoomba Regional Council in relation to the Brisbane West Wellcamp Airport development.

The company has appealed to the Planning and Environment Court after TRC issued infrastructure charges notices in relation to the adjacent Wagners Business Park just before Christmas.

The initial charges are believed to total $1 million but Wagners fear the charges could top $30 million for stormwater alone if extended across the whole business park.

Wagners have lodged seven notices of appeal in court.

Wagners chairman Denis Wagner told media while the company had no issue with paying charges, they needed to be commensurate with the infrastructure provided.

He said there was a lot of stormwater infrastructure built onsite at Wagners’ cost, including detention basins, and the work did not adversely impact a nearby creek.

“The stormwater doesn’t flow through one council pipe,” Mr Wagner said.

He said if the issue of infrastructure charges was not resolved it would stifle development in the region and cost jobs.

Cr Chris Tait told the Courier-Mail the TRC would “vigorously defend its position”, saying the charges related to trunk infrastructure that dealt with stormwater runoff.
