A man who accepted a lift home from the pub from his niece has been disqualified from driving for 10 months and fined $1000.
Neil Vincent Barrett appeared in Murgon Magistrates Court on Tuesday charged with being under the influence of liquor while being in charge of a vehicle.
Police pulled over the car at 7:30pm on April 1 in Lamb Street, Murgon.
Barrett, 47, was sitting in the passenger seat and his niece was behind the wheel but because she was on her “L” plates, Barrett was deemed to be in charge of the vehicle.
When breath-tested, he blew 0.162.
Magistrate Simon Young said if Barrett was not aware of his obligations when he was with a learner driver, he didn’t deserve to have a licence.
He disqualified him from holding a driving licence for 10 months and fined him $1000. A conviction was recorded.
