The Queensland Mental Health Court will decide the state of mind of a Kilkivan man charged with murder over the death of his uncle.

James Neale was charged last year after an investigation into the death of 55-year-old Paul Mann.

Just after 3:00pm on April 12, 2024, police were called to a Running Creek Road address after reports of a disturbance.

They found Mann with critical stab wounds.

Neale then allegedly threatened the attending police officer and was shot.

He was airlifted to the Sunshine Coast University Hospital in a critical condition but has since been discharged from hospital.

Neale’s charges are due to be mentioned again in Gympie Magistrates Court on March 16 when the outcome of the Mental Health Court hearing is expected to be known.
