A man facing two drugs charges today questioned the jurisdiction of Kingaroy Magistrates Court to hear the matter.
Jason Perkins is charged with possessing dangerous drugs, possessing instructions for producing dangerous drugs, and contravening a police direction.
Appearing unrepresented, Perkins was asked by Magistrate Barry Barrett if he was “Jason Perkins”.
“I don’t know that it is,” he replied. “Is Mr Jason Perkins a corporation? I am a man and I have been forced to perform under duress as Jason Perkins.”
Magistrate Barrett noted the “contravene police direction” charge related to Perkins allegedly refusing to supply his name and address to police.
The Magistrate then read out the charges and asked Perkins if he understood them.
“I seek a legal determination to what ‘understand’ means,” Perkins replied.
Perkins then added he was not “entering into any agreements” with the court but asked that the magistrate receive a document from him and read it.
Mr Barrett said he would attach the document to Perkins’ court records.
He adjourned the matter to May 29 and enlarged Perkins’ bail.
Perkins again reiterated he would not enter into any agreements, at which point Police Prosecutor Pepe Gangemi said that if Perkins refused to enter into a bail agreement, he should be held in custody.
However Mr Barrett said he had already enlarged the bail and said Perkins was free to leave.
“I have seen it all before,” Mr Barrett commented.
