September 22, 2014<\/strong><\/p>\n

A 21-year-old Caboolture South man charged over the armed robbery of the Shell Service Station in Nanango on September 15 was refused bail when he appeared in Kingaroy Magistrates Court today.<\/p>\n

Timothy John Somers faces one charge of armed robbery.<\/p>\n

Magistrate Simon Young heard an application for bail from Somers’ defence solicitor Chris Campbell.<\/p>\n

Mr Campbell said his client was young and would agree to the most stringent bail conditions if released.<\/p>\n

The court was also told Somers claimed he had carried out the \u00a0robbery after threats had been made to his de facto wife and unborn child.<\/p>\n

But Mr Young said a police affidavit tendered to the court had stated this information was not highly credible, although investigations were continuing.<\/p>\n

He was not satisfied that Somers – who admitted he had a drinking problem – would not pose a danger to the community if bail was granted.<\/p>\n

Somers was remanded in custody until October 16, when he will appear via videolink from Maryborough Correctional Centre.<\/p>\n

A man who claimed he should only be known as “the witness” and that the Kingaroy Magistrates Court was “unlawful” was rebuked by Magistrate Simon Young today.<\/strong><\/p>\n

Anthony John Weston was appearing by videolink but refused to sit so the Magistrate could see his face on camera.<\/p>\n

Weston was arrested after he failed to appear in Gladstone Court to face charges of public nuisance, two counts of contravening a police direction, trespass, entering premises, assaulting police, driving an unregistered, uninsured vehicle with an altered engine number, and breaching bail.<\/p>\n

Throughout the proceedings, Weston repeatedly claimed he was not “Mr Weston”.<\/p>\n

“Mr Weston, if you are not that person, who are you?” Magistrate Young asked.<\/p>\n

“Why should I say any information to this court. It’s an unlawful court,” he replied.<\/p>\n

Magistrate Young said Weston has put his views to the court in writing but they amounted to what a young child does when they close their eyes and say \u00a0“nobody can see me”.<\/p>\n

He said Weston had a “foolish collection of half-baked ideas” and he had trouble believing that anyone of reasonable mind could believe such nonsense.<\/p>\n

“What is your name?” Mr Young asked again.<\/p>\n

“I do not have a name. Simply refer to me as The Witness,” Mr Weston replied.<\/p>\n

Mr Young said that a witness was a function, not a name.<\/p>\n

He then asked Mr Weston if he wished to apply for bail.<\/p>\n

“I will not answer to the name,” Mr Weston replied.<\/p>\n

Mr Young said he took Weston’s silence as indicating that did not wish to apply for bail.<\/p>\n

He remanded Weston in custody to re-appear at Gladstone Magistrates Court via videolink on September 29.<\/p>\n","protected":false},"excerpt":{"rendered":"
