As predicted at the South Burnett Regional Council’s May meeting, a company denied permission to build a Battery Energy Storage System (BESS) beside the Kingaroy Solar Farm is challenging the decision in court.<\/p>\n

The appellant is M Renewables Australia Developments,\u00a0a subsidiary of Metlen Energy & Metals (formerly known as Mytilineos), the constructors and owners of the Kingaroy Solar Farm.<\/p>\n

Solicitors for M Renewables lodged a Notice Of Appeal in the Planning and Environment Court on June 24.<\/p>\n

King & Company Solicitors, for the SBRC, entered an appearance in the matter last week (July 8).<\/p>\n

M Renewables is seeking orders that its application for a Development Permit for material change of use and reconfigure a lot for the BESS be approved.<\/p>\n

The parcel of land is already subject to a Development Permit for a solar farm.<\/p>\n

In May, councillors acknowledged the company could challenge their decision in court, but also expressed hope the State Government might “call in” the project before any appeal was lodged.<\/p>\n
