{"id":299781,"date":"2021-05-26T20:19:48","date_gmt":"2021-05-26T10:19:48","guid":{"rendered":"https:\/\/southburnett.com.au\/news2\/?p=299781"},"modified":"2021-05-26T20:20:46","modified_gmt":"2021-05-26T10:20:46","slug":"lgaq-to-debate-200-complaint-fee","status":"publish","type":"post","link":"https:\/\/southburnett.com.au\/news2\/2021\/05\/26\/lgaq-to-debate-200-complaint-fee\/","title":{"rendered":"LGAQ To Debate $200 &#8216;Complaint Fee&#8217;"},"content":{"rendered":"<figure id=\"attachment_188616\" aria-describedby=\"caption-attachment-188616\" style=\"width: 200px\" class=\"wp-caption alignright\"><img loading=\"lazy\" class=\"size-full wp-image-188616\" src=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2017\/09\/20170901-greg-hallam-200.jpg\" alt=\"\" width=\"200\" height=\"316\" srcset=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2017\/09\/20170901-greg-hallam-200.jpg 200w, https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2017\/09\/20170901-greg-hallam-200-190x300.jpg 190w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><figcaption id=\"caption-attachment-188616\" class=\"wp-caption-text\">LGAQ chief executive Greg Hallam (Photo: Twitter)<\/figcaption><\/figure>\n<p><strong>May 26, 2021<\/strong><\/p>\n<p>Mt Isa City Council wants to charge people who lodge false or frivolous complaints against councils a $200 fee for unnecessarily running up ratepayer costs.<\/p>\n<p>The Council voted recently to ask the Local Government Association of Queensland (LGAQ) to debate the idea at this year&#8217;s State Conference.<\/p>\n<p>If complaints were upheld &#8211; fully or partially &#8211; the $200 fee would be refunded.<\/p>\n<p>Complaints about operational matters such as fallen trees, potholes or missed garbage collections would not attract any fee.<\/p>\n<p><strong>Mt Isa City Council reckons it has notched up $105,000 in investigation costs for frivolous complaints over the past four months.<\/strong><\/p>\n<p>The complaints were lodged with regulatory bodies such as the Crime and Misconduct Division, the Office Of The Independent Assessor (OIA) or the Queensland Ombudsman.<\/p>\n<p>So far, none of the complaints lodged this year have been upheld.<\/p>\n<p>However the Council has had to pay $105,000 in investigation costs, along with its own internal costs for managing the complaints and providing material to investigators.<\/p>\n<p>A spokesperson for the LGAQ said all motions put forward at the annual State Conference would be considered and debated.<\/p>\n<h2 style=\"text-align: center;\"><strong>* * *<\/strong><\/h2>\n<h3><span style=\"color: #006699;\"><strong>Editorial<\/strong><\/span><\/h3>\n<p><strong>by Dafyd Martindale<\/strong><\/p>\n<p><strong>The problem of frivolous and vexatious complaints has also bedevilled the South Burnett Regional Council.<\/strong><\/p>\n<p>Since the March 2020 elections, Council has fielded 26 complaints about &#8220;serious matters&#8221;.<\/p>\n<p>Only one of these was upheld, and no penalty was imposed.<\/p>\n<p>The remainder were dismissed as frivolous, vexatious, outside the jurisdiction of the OIA, or lacking in substance.<\/p>\n<p>For example, on May 5 this year the following complaint was lodged:<\/p>\n<p style=\"padding-left: 30px;\"><em>It is alleged a councillor has failed to carry out his duties in relation to a council policy.<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>It was further alleged a councillor was not a person of integrity nor is he worthy of the community\u2019s support and respect and that the community has lost faith in the councillor as the councillor&#8217;s deplorable behaviour has brought the region and Council into disrepute.<\/em><\/p>\n<p>This was dismissed by the OIA:<\/p>\n<p style=\"padding-left: 30px;\"><em>The OIA dismissed both matters on the basis that the complaint\/s were vexatious and or not made in good faith pursuant to section 150X(b)(i) of the\u00a0Local Government Act 2009\u00a0(the Act).<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>The allegations have previously been considered by the OIA and dismissed as a vexatious.<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>There were reasonable indications that the complainant in this matter was a fictitious identity.
