{"id":258292,"date":"2020-05-21T11:42:41","date_gmt":"2020-05-21T01:42:41","guid":{"rendered":"https:\/\/southburnett.com.au\/news2\/?p=258292"},"modified":"2020-05-21T11:42:41","modified_gmt":"2020-05-21T01:42:41","slug":"mine-bosses-face-jail-if-negligent","status":"publish","type":"post","link":"https:\/\/southburnett.com.au\/news2\/2020\/05\/21\/mine-bosses-face-jail-if-negligent\/","title":{"rendered":"Mine Bosses Face Jail If Negligent"},"content":{"rendered":"<figure id=\"attachment_98597\" aria-describedby=\"caption-attachment-98597\" style=\"width: 200px\" class=\"wp-caption alignright\"><a href=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2015\/03\/anthonylynham.jpg\"><img loading=\"lazy\" class=\"size-full wp-image-98597\" src=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2015\/03\/anthonylynham.jpg\" alt=\"\" width=\"200\" height=\"316\" srcset=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2015\/03\/anthonylynham.jpg 200w, https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2015\/03\/anthonylynham-190x300.jpg 190w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/a><figcaption id=\"caption-attachment-98597\" class=\"wp-caption-text\">Energy Minister Dr Anthony Lynham<\/figcaption><\/figure>\n<p><strong>May 21, 2020<\/strong><\/p>\n<p>Mining executives could face up to 20 years in jail if workers die because of their criminal negligence under new laws passed in State Parliament this week.<\/p>\n<p>Mines Minister Dr Anthony Lynham said establishing industrial manslaughter as an offence in mines and quarries sent a &#8220;clear message&#8221; to employers and senior officers that the safety and health of their workers was paramount.<\/p>\n<p>\u201cIn the past two years we\u2019ve had eight workers die, and a gas explosion in an underground coal mine has put five miners in hospital,\u201d Dr Lynham said.<\/p>\n<p>\u201cIt\u2019s not acceptable.\u00a0Safety on a mine site is everybody\u2019s responsibility.<\/p>\n<p>\u201cBut a safety culture needs to be modelled right from the top and creating the offence of industrial manslaughter is to ensure senior company officers do all they can to create a safe mine site.<\/p>\n<p>\u201cThese new sanctions bring the resources sector and its workers in line with every other workplace across the State, but with higher financial penalties.\u201d<\/p>\n<p>The new laws also require people in critical statutory safety roles in coal mines to be mine operator employees, not contract workers.<\/p>\n<p>\u201cThis provides these critical officers with confidence that they can raise and report safety issues without fear of reprisal or impact on their employment,\u201d Dr Lynham told Parliament.<\/p>\n<p><strong>The new laws include:<\/strong><\/p>\n<ul>\n<li>Increased maximum penalties for offences to $4 million and powers for the regulator to issue fines without going to court<\/li>\n<\/ul>\n<ul>\n<li>Statewide safety reset sessions for mine and quarry workers to refocus on health and safety<\/li>\n<\/ul>\n<ul>\n<li>Better detection and prevention of black lung, and an improved safety net for affected workers<\/li>\n<\/ul>\n<ul>\n<li>$2.2 million for a mobile screening service to support the early detection and prevention of mine dust lung diseases<\/li>\n<\/ul>\n<ul>\n<li>$35 million to deliver reforms to improve the safety and health of our mine workers<\/li>\n<\/ul>\n<ul>\n<li>A commitment to tighter controls on mine dust levels<\/li>\n<\/ul>\n<ul>\n<li>Establishment of an independent resources health and safety authority from July 1<\/li>\n<\/ul>\n<p>The legislation also reduces the financial risk to taxpayers of rehabilitating abandoned mine sites and removes unfair fees for electricity users in south-east Queensland.<\/p>\n<p><strong>The changes also:<\/strong><\/p>\n<ul>\n<li>Increase scrutiny of the financial capabilities of a resource authority holder when mines and other tenures change hands<\/li>\n<\/ul>\n<ul>\n<li>Increase government oversight of mines that enter into care and maintenance, in particular by requiring significant mines to have development plans<\/li>\n<\/ul>\n<ul>\n<li>Broaden the government\u2019s powers to remediate abandoned mines<\/li>\n<\/ul>\n<ul>\n<li>Widen the grounds to disqualify applicants from having mining tenures<\/li>\n<\/ul>\n<ul>\n<li>Ban electricity retailers charging standard contract customers for late payment, receiving a paper bill or making over-the-counter payments.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Mining executives could face up to 20 years in jail if workers die because of their criminal negligence under new laws passed in State Parliament this week.<\/p>\n","protected":false},"author":20,"featured_media":158370,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[5,3],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v19.11 -
