Acting Attorney-General Dr Anthony Lynham<\/figcaption><\/figure>\n

New human rights legislation came into force in Queensland on January 1.<\/p>\n

Acting Attorney-General Dr Anthony Lynham said the Human Rights Act 2019 meant public entities had a specific obligation to act and make decisions compatible with human rights.<\/p>\n

\u201cQueenslanders will no longer have to rely on a patchwork of protections when they believe their freedom, equality or dignity is being challenged by a public entity,\u201d he said.<\/p>\n

\u201cInstead they will have access to a momentous piece of legislation \u2013 one that protects their human rights when interacting with public entities.<\/p>\n

\u201cThis includes the State Government, Local Government, public service employees and other organisations performing public work.<\/p>\n

\u201cIt\u2019s a significant step towards a human rights-based approach to government planning, policy and service delivery.\u201d<\/p>\n

The Human Rights Act protects 23 human rights:<\/strong><\/p>\n

    \n
  • Recognition and equality before the law;<\/li>\n<\/ul>\n
      \n
    • Right to life;<\/li>\n<\/ul>\n
        \n
      • Protection from torture and cruel, inhuman or degrading treatment;<\/li>\n<\/ul>\n
          \n
        • Freedom from forced work;<\/li>\n<\/ul>\n
            \n
          • Freedom of movement;<\/li>\n<\/ul>\n
              \n
            • Freedom of thought, conscience, religion and belief;<\/li>\n<\/ul>\n
                \n
              • Freedom of expression;<\/li>\n<\/ul>\n
                  \n
                • Peaceful assembly and freedom of association;<\/li>\n<\/ul>\n
                    \n
                  • Taking part in public life;<\/li>\n<\/ul>\n
                      \n
                    • Property rights;<\/li>\n<\/ul>\n
                        \n
                      • Privacy and reputation;<\/li>\n<\/ul>\n
                          \n
                        • Protection of families and children;<\/li>\n<\/ul>\n
                            \n
                          • Cultural rights \u2014 generally;<\/li>\n<\/ul>\n
                              \n
                            • Cultural rights \u2014 Aboriginal people and Torres Strait Islanders;<\/li>\n<\/ul>\n
                                \n
                              • Right to liberty and security of person;<\/li>\n<\/ul>\n
                                  \n
                                • Humane treatment when deprived of liberty;<\/li>\n<\/ul>\n
                                    \n
                                  • Fair hearing;<\/li>\n<\/ul>\n
                                      \n
                                    • Rights in criminal proceedings;<\/li>\n<\/ul>\n
                                        \n
                                      • Children in the criminal process;<\/li>\n<\/ul>\n
                                          \n
                                        • Right not to be tried or punished more than once;<\/li>\n<\/ul>\n
                                            \n
                                          • Retrospective criminal laws;<\/li>\n<\/ul>\n
                                              \n
                                            • Right to education; and<\/li>\n<\/ul>\n
                                                \n
                                              • Right to health services.<\/li>\n<\/ul>\n

                                                Dr Lynham said the newly established Queensland Human Rights Commission, which replaces the Anti-Discrimination Commission, would administer the Human Rights Act.<\/p>\n

                                                \u201cThe Queensland Human Rights Commission will also have the power to receive and conciliate human rights complaints,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"
