{"id":244183,"date":"2019-09-13T18:24:06","date_gmt":"2019-09-13T08:24:06","guid":{"rendered":"https:\/\/southburnett.com.au\/news2\/?p=244183"},"modified":"2019-09-13T18:24:06","modified_gmt":"2019-09-13T08:24:06","slug":"agforce-dismayed-by-court-ruling","status":"publish","type":"post","link":"https:\/\/southburnett.com.au\/news2\/2019\/09\/13\/agforce-dismayed-by-court-ruling\/","title":{"rendered":"AgForce Dismayed By Court Ruling"},"content":{"rendered":"<figure id=\"attachment_207401\" aria-describedby=\"caption-attachment-207401\" style=\"width: 200px\" class=\"wp-caption alignright\"><a href=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/04\/mikeguerin1.jpg\"><img loading=\"lazy\" class=\"size-full wp-image-207401\" src=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/04\/mikeguerin1.jpg\" alt=\"\" width=\"200\" height=\"317\" srcset=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/04\/mikeguerin1.jpg 200w, https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/04\/mikeguerin1-189x300.jpg 189w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/a><figcaption id=\"caption-attachment-207401\" class=\"wp-caption-text\">AgForce CEO Mike Guerin (Photo: AgForce)<\/figcaption><\/figure>\n<p><strong>September 13, 2019<\/strong><\/p>\n<p>AgForce says a decision by the High Court this week has made vegetation management for Queensland primary producers even more confusing, exposing them to fines of up to $600,000 per breach.<\/p>\n<p>The High Court decision upheld the power of councils to control vegetation management on &#8220;Category X&#8221; land \u2013 which AgForce says makes up about 20 per cent of Queensland \u2013 where there is a local planning scheme in place.<\/p>\n<p>The decision endorsed a similar ruling by the Queensland Court of Appeal in May, effectively adding another layer of regulation.<\/p>\n<p>Thinning or clearing of any vegetation on &#8220;Category X&#8221; land, previously exempt under the State\u2019s Vegetation Management Act, could now require planning approval from the local council \u2013 a process that could take weeks .<\/p>\n<p><strong>AgForce CEO Michael Guerin said the ruling had made effective, legally compliant landscape management virtually impossible for most producers.<\/strong><\/p>\n<p>\u201cLandholders now have to know, understand and comply with legislation and regulations by all three levels of government, much of which is contradictory,\u201d he said.<\/p>\n<p>\u201cThis is a disastrous outcome for producers at a time when many need to urgently clear firebreaks ahead of a predicted brutal fire season, control weeds and invasive plants, and use vegetation as fodder for cattle starving due to the record drought.<\/p>\n<p>\u201cEvery week we hear of producers who are fined for unknowingly breaching various State Government vegetation management regulations simply because the legislation is both confusing and ever-changing.<\/p>\n<p>\u201cBetween the Vegetation Management Act, protected plants trigger mapping and now local planning schemes, farmers simply don\u2019t know what they can and can\u2019t do on their properties.<\/p>\n<p>\u201cIronically, this decision will ultimately harm the environment by adding to the complexity of rules already faced by farmers.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>AgForce says a decision by the High Court this week has made vegetation management for Queensland primary producers even more confusing, exposing them to fines of up to $600,000 per breach.<\/p>\n","protected":false},"author":20,"featured_media":207400,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[3,36],"tags":[1134],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v19.11 -
