{"id":212504,"date":"2018-06-28T12:58:47","date_gmt":"2018-06-28T02:58:47","guid":{"rendered":"https:\/\/southburnett.com.au\/news2\/?p=212504"},"modified":"2020-07-29T11:10:41","modified_gmt":"2020-07-29T01:10:41","slug":"crackdown-on-real-estate-rorts","status":"publish","type":"post","link":"https:\/\/southburnett.com.au\/news2\/2018\/06\/28\/crackdown-on-real-estate-rorts\/","title":{"rendered":"Crackdown On Real Estate Rorts"},"content":{"rendered":"<figure id=\"attachment_268399\" aria-describedby=\"caption-attachment-268399\" style=\"width: 200px\" class=\"wp-caption alignright\"><img loading=\"lazy\" class=\"size-full wp-image-268399\" src=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/07\/dath200x350.jpg\" alt=\"\" width=\"200\" height=\"350\" srcset=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/07\/dath200x350.jpg 200w, https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/07\/dath200x350-171x300.jpg 171w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><figcaption id=\"caption-attachment-268399\" class=\"wp-caption-text\">Queensland Attorney-General Yvette D\u2019Ath<\/figcaption><\/figure>\n<p><strong>June 28, 2018<\/strong><\/p>\n<p>A joint agency crackdown on real estate agents withholding tenants\u2019 bonds in Queensland has led to investigations against 13 agents, with a further 20 targeted for follow-up.<\/p>\n<p>The Office of Fair Trading (OFT) and the Residential Tenancies Authority (RTA) partnered for a joint compliance operation during January to April.<\/p>\n<p>Attorney-General Yvette D\u2019Ath said the operation was established in response to concerns that tenants\u2019 rights were being ignored by agents who weren\u2019t lodging bonds with the RTA within required timeframes.<\/p>\n<p>\u201cBond money does not belong to a real estate agent and must be transferred to the RTA correctly and within legislated timeframes,\u201d Mrs D\u2019Ath said.<\/p>\n<p>\u201cMost agents are doing the right thing. But it\u2019s important that tenants are treated fairly and legally, and I\u2019m pleased to see action taken against non-compliant agencies.<\/p>\n<p>\u201cThis behaviour also impacts on the broader integrity of the industry and I know agents welcome such investigations so that all are not tarred with the same brush.\u201d<\/p>\n<p><strong>The OFT issued statutory notices to 54 real estate agencies across the State, requesting agents provide their rent roll information to the OFT.<\/strong><\/p>\n<p>The rent rolls were then compared against bonds held with the RTA to identify any potential bond money discrepancies.<\/p>\n<p><strong>Of the 54 statutory notices issued:<\/strong><\/p>\n<ul>\n<li>21 agencies were deemed compliant with no discrepancies identified<\/li>\n<\/ul>\n<ul>\n<li>20 agencies featured discrepancies between their rent rolls and the RTA register of lodged bonds and required further investigation by both OFT and the RTA<\/li>\n<\/ul>\n<ul>\n<li>9 agencies required further follow up investigation by the RTA<\/li>\n<\/ul>\n<ul>\n<li>4 agencies were found to be non-compliant, with other issues identified including misapplication of trust monies, and these agencies are now subject to investigations being undertaken by the OFT.<\/li>\n<\/ul>\n<p><strong>Housing Minister Mick de Brenni said the operation demonstrated the value of data sharing between agencies to ensure statutory requirements were upheld in the industry.<\/strong><\/p>\n<p>\u201cData sharing between agencies means better service for Queenslanders, but it also enhances the RTA\u2019s enforcement and compliance capabilities,\u201d he said.<\/p>\n<p>\u201cSome of the agencies identified as being non-compliant had failed to lodge upwards of 60 bonds.<\/p>\n<p>&#8220;Operation Bond has meant OFT and the RTA have been able to identify and deal with these in a single operation, rather than having to undertake 60 or more separate investigations.<\/p>\n<p>\u201cQueenslanders should be able to have confidence that OFT and the RTA are ensuring real estate licensees are acting fairly and lawfully.\u201d<\/p>\n<p>Mrs D\u2019Ath said the OFT would continue to investigate allegations of real estate agents who misappropriate bond money and take action against those who do.<\/p>\n<p>\u201cIf you think a real estate salesperson or agent may have inappropriately dealt with your bond money I\u2019d encourage you to lodge a complaint with the OFT,\u201d Mrs D\u2019Ath said.<\/p>\n<p><strong>A complaint can be lodged at <a href=\"http:\/\/www.qld.gov.au\/fairtrading\" target=\"_blank\" rel=\"noopener\">www.qld.gov.au\/fairtrading<\/a> or with the RTA at <a href=\"http:\/\/www.rta.qld.gov.au\" target=\"_blank\" rel=\"noopener\">www.rta.qld.gov.au<\/a> or by calling 1300-366-311.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A joint agency crackdown on real estate agents withholding tenants\u2019 bonds in Queensland has led to investigations against 13 agents, with a further 20 targeted for follow-up.<\/p>\n","protected":false},"author":20,"featured_media":268400,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[5,3],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v19.11 -
