{"id":210909,"date":"2018-06-11T14:34:09","date_gmt":"2018-06-11T04:34:09","guid":{"rendered":"https:\/\/southburnett.com.au\/news2\/?p=210909"},"modified":"2020-06-23T10:34:41","modified_gmt":"2020-06-23T00:34:41","slug":"gayndah-meeting-to-discuss-ilua","status":"publish","type":"post","link":"https:\/\/southburnett.com.au\/news2\/2018\/06\/11\/gayndah-meeting-to-discuss-ilua\/","title":{"rendered":"Gayndah Meeting To Discuss ILUA"},"content":{"rendered":"<figure id=\"attachment_210910\" aria-describedby=\"caption-attachment-210910\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/06\/landclaims.jpg\"><img loading=\"lazy\" class=\"size-full wp-image-210910\" src=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/06\/landclaims.jpg\" alt=\"\" width=\"300\" height=\"319\" srcset=\"https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/06\/landclaims.jpg 300w, https:\/\/southburnett.com.au\/news2\/wp-content\/uploads\/2018\/06\/landclaims-282x300.jpg 282w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-210910\" class=\"wp-caption-text\">Active Native Title claims in the South and North Burnett areas<\/figcaption><\/figure>\n<p><strong>June 11, 2018<\/strong><\/p>\n<p>A meeting to be held at Gayndah on June 30 is the next step in a decades-long process by Wakka Wakka native title claimants to gain legal recognition.<\/p>\n<p>The descendants of various people identified\u00a0 in Native Title claims &#8220;<strong><a href=\"http:\/\/www.nntt.gov.au\/searchRegApps\/NativeTitleRegisters\/Pages\/RNTC_details.aspx?NNTT_Fileno=QC2016\/003\" target=\"_blank\" rel=\"noopener\">Wakka Wakka People #3<\/a><\/strong>&#8221; and &#8220;<strong><a href=\"http:\/\/www.nntt.gov.au\/searchRegApps\/NativeTitleRegisters\/Pages\/RNTC_details.aspx?NNTT_Fileno=QC2012\/003\" target=\"_blank\" rel=\"noopener\">Wakka Wakka People #4 (part)<\/a><\/strong>&#8221; will meet at Gayndah Town Hall to consider authorising an Indigenous Land Use Agreement (ILUA) with Gympie Regional Council.<\/p>\n<p>They will then discuss forming a Registered Native Title Body Corporate, which would be the official holder if Native Title is determined by the Federal Court in either a consent agreement or after a trial.<\/p>\n<p>Wakka Wakka People #3 was lodged with the Native Title Tribunal on December 12, 2011, and registered on January 19, 2012.\u00a0Another claim, Wakka Wakka People #5, also lodged in February 2012, was\u00a0combined with\u00a0Wakka Wakka People #3 in March 2016.<\/p>\n<p>This combined claim stretches from the Bunya Mountains to near Gayndah and includes areas around Goomeri, Murgon, Cherbourg, Proston, Wondai, Kingaroy, Nanango, and Maidenwell.<\/p>\n<p>Wakka Wakka People #4 includes areas around Gayndah, west of Eidsvold and Ban Ban Springs.\u00a0It was lodged on February 10, 2012, and registered on April 5, 2012.<\/p>\n<p><strong>southburnett.com.au<\/strong> understands that negotiations with other councils in regards to an ILUA covering their part of these active claims are still ongoing.<\/p>\n<p>There has been a long history of native title claims in the South and North Burnett areas, dating back to 1997.\u00a0<\/p>\n<p>Four previous claims on behalf of various groups have either been discontinued, dismissed or struck out.<\/p>\n<p style=\"text-align: center;\"><strong>* * *<\/strong><\/p>\n<p><strong>Native Title has been extinguished in most of the affected areas:<\/strong><\/p>\n<ul>\n<li>Native title\u00a0<strong>cannot<\/strong>\u00a0be claimed in areas where it has been extinguished, such as privately owned land (residential freehold and privately owned freehold farms),\u00a0residential, commercial or community purpose leases,\u00a0\u00a0public work areas such as schools, roads or hospitals; and\u00a0pastoral or agricultural leases that grant exclusive possession.<\/li>\n<\/ul>\n<ul>\n<li>Native title\u00a0<strong>can<\/strong>\u00a0be claimed on vacant Crown land which is unoccupied or unallocated; some State Forests, National Parks and public reserves;\u00a0inland waters;\u00a0\u00a0some leases, such as non-exclusive pastoral and agricultural leases; and\u00a0some land held for Aboriginal people.
