August 18, 2016<\/strong><\/p>\nTwo 18-year-old youths appeared briefly by videolink in Kingaroy Magistrates Court on Thursday afternoon charged with the attempted armed robbery of the United Petroleum (Ryke Fuel) service station in Kingaroy.<\/p>\n
Keylan Tangimoana Ryder Wharehinga, from Nanango, and Jayke Anthony Oliver, from Caboolture, were charged with the attempted armed robbery of Ryke Fuel on August 16.<\/p>\n
The pair – plus two juveniles whom police will allege acted as “cockatoos” for the attempted robbery – were arrested on Wednesday in Youngman Street.<\/p>\n
Police Prosecutor Sgt Wayne Bushell formally opposed bail. He tendered to the court a photograph of the machete allegedly used during the attempted hold-up.<\/p>\n
However, he said the likelihood of imprisonment for the pair, if convicted, was low and that a period on probation was the most likely outcome because of their age and record.<\/strong><\/p>\nDuty solicitor Mark Werner said Wharehinga was seeking to have his matter adjourned until tomorrow for a bail application.<\/p>\n
Magistrate Andrew Hackett remanded Wharehinga in custody to reappear by videolink at 3:00pm on Friday.<\/p>\n
Mr Werner said Oliver was seeking bail.<\/p>\n
“A strong Crown case is conceded but there is certainly no guarantee that on a plea of guilty, it would lead to a period of imprisonment,” Mr Werner said.<\/p>\n
He said it would be an injustice for Oliver to be held in custody until the matter was dealt with, which could be as long away as next year.<\/p>\n
Mr Hackett agreed, saying to hold him custody for a long period would be disproportionate to the likely outcome of probation if he was convicted or pleaded guilty.<\/p>\n
Oliver was granted bail on condition he live at an address at Loganlea, report weekly to police, obey an 8:00pm to 6:00am curfew and stay away from the victim of the attempted robbery.<\/p>\n
“You’re on a fairly tight leash here,” Mr Hackett warned Oliver. “If you don’t comply with your bail conditions you could be in custody for three, four, five or six months.”<\/p>\n
He reminded Oliver that police could check on him at any time to ensure he was obeying the curfew restrictions.<\/p>\n
The case was adjourned for mention on October 10 in Kingaroy Magistrates Court.<\/p>\n","protected":false},"excerpt":{"rendered":"
