Men charged under past anti-gay legislation in Queensland look set to have their convictions expunged.<\/p>\n

Attorney-General Yvette D\u2019Ath said the Queensland Law Reform Commission would investigate how historical convictions for consensual homosexual conduct could be removed from a person\u2019s criminal record.<\/p>\n

\u201cThis is about doing what is right, what is fair and what is just for all Queenslanders,\u201d Mrs D\u2019Ath said. \u201cAnd it delivers on a significant election commitment we made to the people of this State.<\/p>\n

\u201cThis is a complex issue due to the technicalities of Queensland\u2019s Criminal Code and the historic nature of these cases.<\/p>\n

\u201cThe QLRC will use its experience to consider the best approach to expunge these historical criminal convictions.<\/p>\n

“This sends the clear message that outdated and intolerant attitudes towards our gay community belong in the past.<\/strong><\/p>\n

\u201cReferring this issue is an important step that shows we are serious about delivering on our election commitment to remove these archaic convictions from the criminal histories of men who should never have been charged.<\/p>\n

\u201cOur community recognises that consensual sexual activity between adults should not be treated differently simply because of a person\u2019s sexuality.<\/p>\n

\u201cOur laws have acknowledged consensual homosexual sex as legal since 1991. It\u2019s time to ensure that members of our community are not burdened by criminal convictions for something that should never have been a crime in the first place.\u201d<\/p>\n

Mrs D\u2019Ath said the QLRC would consult widely and report back by August 31.<\/p>\n
