A man who accepted a lift home from the pub from his niece has been disqualified from driving for 10 months and fined $1000.<\/p>\n

Neil Vincent Barrett appeared in Murgon Magistrates Court on Tuesday charged with being under the influence of liquor while being in charge of a vehicle.<\/p>\n

Police pulled over the car at 7:30pm on April 1 in Lamb Street, Murgon.<\/p>\n

Barrett, 47, was sitting in the passenger seat and his niece was behind the wheel but because she was on her “L” plates, Barrett was deemed to be in charge of the vehicle.<\/p>\n

When breath-tested, he blew 0.162.<\/p>\n

Magistrate Simon Young said if Barrett was not aware of his obligations when he was with a learner driver, he didn’t deserve to have a licence.<\/p>\n

He disqualified him from holding a driving licence for 10 months and fined him $1000. A conviction was recorded.<\/p>\n

A man charged with rape entered no plea when he appeared via videolink in Murgon Magistrates Court.<\/strong><\/p>\n

Solicitor Tim Campion, on behalf of his client, consented to a full hand-up committal with no cross-examination of witnesses.<\/p>\n

Magistrate Young said a prima facie case existed and ordered the man to appear in the District Court in Kingaroy on a date to be fixed.<\/p>\n
